A surprise toy can be found inside this capsule. Thus the toy is enclosed in the edible part.

Kinder surprise is banned in the USA. It is illegal to sell or buy this sweet treat in the entire country because of an old law.
This law prohibits the selling of a food item that has a non-nutritive item enclosed inside of it. Since the capsule and the toy found inside a kinder surprise is a non-nutritive item and does not help with the nutrition of the edible part at all, it falls under the category of unsafe food product.
This is not an empty law. Many deaths have been reported all over the world due to children choking on the small toys found inside the kinder surprise.
